Terms and Conditions

The Competition

The competition, operated by the promoter, is governed by these terms and conditions.

The Prize

The prize in this competition is the property, 3 Bramble Close, Northfield, Birmingham. B31 1NH.

The property will be free from mortgage or any other debt upon transfer to the winning entrant.

If the number of entries falls short of the value of the property plus expenses, the house will be substituted for a cash prize as calculated below.

The Promoter

The promoter of this competition is: Redwood Events, 3 Bramble Close, Northfield, Birmingham, B31 1NH.

The promoter's decision will be final in all matters relating to this competition and no correspondence will be entered into.

The Entrant

The entrant will enter the competition by paying an entry fee of £25 (sterling).

The entrant will demonstrate skill and judgement in answering the entry question.

By entering the competition, the entrant agrees to and will abide by the terms and conditions.

The winning entrant must agree to their personal details, as described below, being used for promotional purposes in conjunction with this and future competitions run by the promoter, Redwood Events.

The winning entrant will be required to produce a passport and driving license or other suitable documentation in order to authenticate their identity prior to transfer of the title to the property.

The winning entrant must agree to complete legal transfer within 28 days of the competition draw.

The winning entrant will ensure that the prize is registered at HM Land Registry in the winning entrant's name.

All entrants to the competition must be over 18 years of age.

Any entry made by a person under the age of 18 will be deemed void and no refund will be given.

All entries to the competition are final and no refunds will be made for any reason except in the case of entries being submitted after the closing date.

The Winning Entrant

The winning entrant will be the entrant chosen at random on or after the closing date from those entrants who have answered the entry question correctly.

Competition Dates

The competition runs from 12pm 1st December 2008 to 10pm 7th February 2009. No entries received after the closing date will be considered for the final draw. The promoter reserves the right to extend the closing date by up to 2 weeks should the competition be close to achieving the value of the house. This extension will be publicised on the Redwood events website as well as on TheTicketSellers.

General

By entering the competition, entrants are deemed to have read and accepted these terms and conditions and agree to be bound by them.

Upon entering the competition, all entrants must submit all contact details requested by the promoter (which must include a valid e-mail address). This information will be used for the following purposes:

The promoter will comply with the Privacy Policy, as laid out below.

All entrants are solely and completely responsible for providing the promoter with accurate and current contact details.

The promoter will be in no way liable for any failure or inability to make contact with any entrant due to any errors, omissions or inaccuracies in the contact details provided by the entrants.

By entering into the competition, all entrants acknowledge that their payment of £25.00 (GBP) per entry is purely to answer the questions and solve the clues and therefore that entry to the competition does not in any way guarantee the winning of the prize.

The promoter does not in any way guarantee the value of the prize.

Only completed entries will be entered into the competition.

As a condition of entering the competition, entrants must ensure that, by doing so, they do not contravene any laws of their country of residence. The promoter will not be liable in any way if an entrant enters the competition unlawfully.

All entrants recognise that the competition is a Prize Competition for the purposes of, inter alia, Section 14 (5) of the Gambling Act 2005 and that the winning of the competition depends to a substantial degree on the exercise of the skill, judgment and knowledge of the entrants and that the prize is not allocated wholly by chance.

The entrants and the promoter recognise that the competition, its administration and all associated activities are governed by English Law and the promoter and entrants recognise that the County or High Courts of England shall have exclusive jurisdiction in the event of any dispute arising out of the competition or its administration.

By entering the competition, entrants warrant that all information they provide is accurate, true, current and complete. The promoter reserves the right to disqualify any entrant (entirely at their own discretion) if there are reasonable grounds to believe the entrant has acted in breach of any of these terms and conditions.

There is no limit to the number of entries that any one person can make in this competition.

All entries will become the property of the promoter on receipt and will not be returned.

Entrants will receive confirmation of the receipt of their entry from the promoter within 2 days of receipt of their entry into the competition.

It is the sole responsibility of the entrant to retain a copy of the confirmation referred to above for their future reference.

The promoter reserves the right to amend these terms and conditions at any time and for any reason.

Payments will only be accepted in pounds sterling.

English is the only language in which an entrant may submit their entry.

The process to determine the winning entrant will begin on the day after the closing date and a final decision will be made within 7 days of that date.

When the closing date is reached, the competition will close.

The winning entrant of the prize will be the entrant whose details are randomly drawn before an audience of invited guests and in the presence of a solicitor.

The promoter's decision is final and no correspondence will be entered into about the result of the competition following the determination of the winning entrant as described above.

Each entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to this Prize Competition.

If the winning entrant cannot be contacted by the promoter within 30 days of being notified of their status as the winning entrant by e-mail, telephone and mail according to the contact details submitted in their entry, the promoter shall be entitled to award the prize by drawing another winning entry at random in the same method as described above. The winner of this subsequent draw shall be the alternate winning entrant. The alternate winning entrant shall have 7 days from notification of their status by the promoter to communicate their acceptance of the prize.

Closing the Competition

If the number of entries received as at the closing date does not provide the amount of entry fees equal to the value of the property plus expenses incurred, the competition will close and the proceeds of the competition will be determined using the formula:

number of tickets sold x ticket price (the entry fees)

The winning entrant of the competition will then be determined in accordance with the method described above.

After the deduction of all expenses from the total prize fund, the balance will be appropriated as follows. 75 % to the winning entrant and 25% to the promoter.

Further Conditions

All entry fees will be maintained in a client account held by TheTicketSellers until the winning entrant of the competition has been determined.

The winning entrant agrees to allow the promoter to publish his or her name in accordance with the Privacy Policy. The name, age and town of residence of the winning entrant will be published for the purposes of announcing the winning entrant of the competition within 24 hours of the winning entrant being determined.

Entrants authorise the promoter to enter their personal details into their database and to use the information in accordance with the provisions of the Data Protection Act 1998 and subject to the terms of Privacy Policy.

The promoter makes no representation or warranty as to the valuation of the prize, its structural or cosmetic condition or its ability to be sold. Entrants should make their own enquiries and, if necessary, take legal advice about the prize before entering the competition.

Save for death or personal injury the promoter will not be liable for any loss (including economic loss) suffered to or sustained by any person or property as a result of any act or omission of the promoter, nor will their servants or their agents in developing, planning and administrating the competition, distributing the prize to the winning entrant or following the distribution of the prize.

The promoter accepts no liability for errors or omissions contained within the prize details, its description or specification. It is the responsibility of each entrant (and in particular the winning entrant) to satisfy himself or herself as to the accuracy of any such details.

The promoter will not be liable for any loss suffered by an entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the website.

The promoter does not accept responsibility for entries which are not received because of failures in computer systems, other malfunctions, high Internet traffic, hardware failure, software failure or server faults or for any other reason. It is the responsibility of entrants to contact the promoter if they have not received their confirmation of entry as described above within 5 days of its submission.

These competition rules shall not create, or be construed as creating, any form of contract, joint venture or other agreement between any entrant and the promoter.

An entry shall be declared void (without any refund being given) if the entrant engages in any of the following:

Privacy Policy

The entrants and the promoter recognise that the promoter may use contact details and other data, including personal data as defined by the Data Protection Act 1998, supplied by the entrants to the promoter to conduct the competition according to these terms and conditions. The entrants and the promoter also recognise that the promoter may (either by choice or at the request of a third party) also disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.
